Terms of Service

Welcome to Avklare. These Terms of Service ("Terms") govern your use of the Avklare application and website (together, the "Service"), operated by Infogen, Inc / Avklare ("we," "us," "our").

By creating an account or using Avklare, you agree to these Terms. If you don't agree, please don't use the Service.

1. Beta Software Notice

Avklare is currently in beta. This means:

Features may change, break, or be removed without notice.
Bugs happen. We do our best, but we make no guarantees about uptime, reliability, or data integrity during this phase.
We are not responsible for lost, corrupted, or deleted data. While we take reasonable steps to protect your information, you should not treat Avklare as your only copy of anything mission-critical. Keep your own backups of anything you can't afford to lose.
We may reset, wipe, or migrate the beta database as the product evolves. We'll try to give notice when we can, but during beta this isn't guaranteed.

2. Who Can Use Avklare

You must be at least 18 years old to create an account. By registering, you confirm that you meet this requirement.

3. Your Account

You're responsible for keeping your login credentials secure.
You're responsible for all activity that happens under your account.
One person, one account — don't share credentials with people outside your invited workspace.
If you invite others to your workspace, you're responsible for making sure they also follow these Terms.

4. Your Content

You own the tasks, categories, and other content you create in Avklare ("Your Content"). We don't claim ownership over it.

By using the Service, you grant us a limited license to store, process, and display Your Content back to you (and to anyone you've invited to your workspace) — solely for the purpose of operating the Service. This includes sending relevant data to our AI provider (Anthropic) when you use AI-powered features like Workspace Insights or Smart Task Placement, and to our email provider (Brevo) when we send you transactional emails like invitations.

5. Acceptable Use

Please don't:

Use Avklare for anything illegal.
Try to break, exploit, or overload the Service.
Attempt to access another tenant's workspace or data without authorization.
Use the Service to store or share content that's abusive, harassing, or infringes on someone else's rights.
Reverse-engineer or scrape the Service.

We reserve the right to suspend or terminate accounts that violate these rules.

6. Subscriptions & Billing

This section will be expanded once paid plans go live. For beta: features described as "Pro" or "Premium" may be granted temporarily via trial or invitation and are subject to change.

Free, Pro, and Premium tiers have different feature limits, described in-app.
We may change pricing or feature tiers with notice.
Paid subscriptions, once billing is live, will be described in a future update to these Terms.

7. AI-Powered Features

Some features (Workspace Insights, Smart Task Placement, Daily Inspiration) use a third-party AI service (Anthropic's Claude) to analyze your task data and generate suggestions. These are provided as a convenience and may occasionally be inaccurate or unhelpful — use your own judgment.

8. No Warranty

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We don't guarantee the Service will be uninterrupted, secure, timely, or error-free.

9. Limitation of Liability

To the fullest extent permitted by law, Infogen, Inc / Avklare will not be liable for any indirect, incidental, special, or consequential damages arising from your use of (or inability to use) the Service — including but not limited to lost data, lost profits, or lost productivity.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, or at our discretion during the beta period with reasonable notice where practical.

11. Changes to These Terms

We may update these Terms, as well as our Privacy Policy, as the Service evolves, especially as we exit beta. We'll update the "Last updated" date above and notify you as best reasonably possible. Continued use of the Service after changes means you accept the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict of law principles.
